Unlike many states in which surrogacy agreements are illegal or unenforceable, Illinois law allows intended parents and surrogates to enter into legally enforceable agreements, providing security and legal protections for all parties involved. Illinois also provides an opportunity for intended parents to be recognized as a child’s legal parents from the moment that child is born without an adoption or court proceeding so long as at least one of the parents is the genetic parent of that child.
